Terms of Use

The Services are intended for users who are at least 18 years old and are legal residents of the United States. By using the App, you represent and warrant that you are at least 18 years of age, are legally capable of entering into a binding contract, and that your use of the Services does not violate any applicable law. We may, in our sole discretion, refuse to offer the Services to any person or entity and change the eligibility criteria at any time.

Hey Jessica provides financial education, coaching, and personal-finance tools designed to help women build financial confidence and pursue financial goals, including educational courses and content, budgeting and spending-pattern tools (including insights generated from financial accounts you choose to connect via Plaid Inc.), goal-tracking features, community and coaching programs, and related content (collectively, the “Content”).

IMPORTANT: Hey Jessica is an educational and coaching platform only. Hey Jessica is not a registered investment adviser, broker-dealer, bank, credit counseling agency, financial planner, accountant, or law firm, and is not registered with, endorsed by, or affiliated with the U.S. Securities and Exchange Commission, FINRA, or any state securities or banking regulator.

Nothing provided through the App constitutes, and should not be construed as, individualized investment, financial, legal, accounting, or tax advice, or a recommendation to buy, sell, or hold any security or to pursue any particular financial strategy. All Content is provided for general educational and informational purposes only.

You are solely responsible for evaluating the merits and risks associated with any financial decision, and you should consult a licensed and qualified financial advisor, accountant, or attorney before making any financial, investment, tax, or legal decision. Hey Jessica does not guarantee any specific financial outcome, result, savings amount, investment return, or level of "financial freedom" from use of the App, and past performance of any strategy or program discussed in the App is not indicative of future results.

The Services feature an artificial intelligence-powered digital mentor, automated interactive tools, deep fake audio/video technology, and conversational AI agents (collectively, "AI Features"). You expressly acknowledge and agree that:

The App intends to integrate with Plaid. Once the integration is complete, the App will allow you to voluntarily connect one or more financial accounts through Plaid's account-linking technology so that Hey Jessica can analyze your spending patterns and provide personalized budgeting insights and educational guidance. By using this feature, you authorize Plaid to retrieve, transmit, and store certain financial account information on your behalf, and you authorize Hey Jessica to access and use that information as described in our Privacy Policy.

To access certain features of the App, you must register for an account and provide accurate, current, and complete information as prompted. You are responsible for safeguarding your account credentials and for all activity that occurs under your account, whether or not authorized by you.

You agree to notify us immediately at support@heyjessica.app of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Certain Content, programs, or features may require payment of a one-time fee or recurring subscription fee (“Fees”). All Fees are described within the App prior to purchase and are processed by our third-party payment processor.

By purchasing a subscription, you authorize us (or our payment processor) to charge your chosen payment method on a recurring basis until you cancel, in accordance with the billing cycle disclosed at the time of purchase.

Subject to your compliance with these Terms, Hey Jessica grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a personal device that you own or control, solely for your personal, non-commercial use. This license does not include any right to:

The App and all Content, including text, graphics, logos, the "Hey Jessica" name and marks, courses, curricula, videos, audio, software, and the compilation and arrangement thereof, are owned by Company or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 6, no right, title, or interest in the App or Content is transferred to you.

The App may allow you to submit, post, or share content, including comments, journal entries, goals, or community posts (“User Content”). You retain ownership of your User Content, but by submitting it, you grant Hey Jessica a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content in connection with operating, promoting, and improving the Services. You represent that you have all necessary rights to submit your User Content and that it does not violate any third party's rights or applicable law.

We reserve the right, but do not assume any obligation, to monitor, review, remove, or restrict access to any User Content, in our sole discretion and without notice.

You agree not to engage in the following conduct:

If the App includes community forums, group coaching, chat, or similar interactive features, you acknowledge that such features may include content and interactions with other users and, where applicable, coaches or facilitators.

Hey Jessica does not endorse and is not responsible for the accuracy of statements made by other users or third-party coaches within these features, and any guidance shared in a community or group setting is educational and general in nature, not individualized financial advice.

The App may contain links to, or integrations with, third-party websites, applications, or services, including Plaid and payment processors, that are not owned or controlled by Hey Jessica. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party service. Your interactions with any third-party service are solely between you and that third party, and you use such services at your own risk.

THE APP AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. HEY JESSICA DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

HEY JESSICA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY FINANCIAL DATA RECEIVED THROUGH PLAID OR ANY LINKED FINANCIAL INSTITUTION AND IS NOT RESPONSIBLE FOR ANY FINANCIAL DECISION YOU MAKE IN RELIANCE ON SUCH DATA OR ON ANY CONTENT PROVIDED THROUGH THE APP. NO CONTENT PROVIDED THROUGH THE APP SHOULD BE CONSTRUED AS A GUARANTEE OR PROMISE OF ANY PARTICULAR FINANCIAL OUTCOME.

TO THE FULLEST EXTENT PERMITTED BY LAW, HEY JESSICA EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY DECISIONS, LOSSES, ACTIONS, OR INACTIONS YOU TAKE IN RELIANCE UPON AI-GENERATED CONTENT, DEEP FAKE AUDIO/VIDEO, OR AUTOMATED BUDGETING SUGGESTIONS. THE AI AGENT IS AN EDUCATIONAL SIMULATION AND DOES NOT CONSTITUTE PROFESSIONAL FINANCIAL COUNSELING, TAX ADVICE, OR INVESTMENT MANAGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HEY JESSICA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEY JESSICA’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HEY JESSICA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Hey Jessica and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

We may suspend or terminate your access to the App at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. You may terminate your account at any time by following the account deletion process within the App or by contacting us.

Upon termination, your right to use the App will immediately cease, and Sections 6 through 17 of these Terms will survive termination.

We reserve the right to modify, suspend, or discontinue the App, or any part of it, at any time without liability to you. We may also revise these Terms from time to time. If we make material changes, we will provide notice, such as by updating the “Last Updated” date above or through an in-app or email notification. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms.

PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR RIGHTS. You and Hey Jessica agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App (“Dispute”) will be resolved through binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

These Terms and any Dispute not subject to arbitration will be governed by the laws of the State of New Jersey, without regard to its conflict of laws principles.

For any Dispute not subject to arbitration, or for any claim seeking injunctive relief, you and Hey Jessica agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in New Jersey.
